Warranty Terms

Custom Iron On Patches Ltd (“the Company”, “we”, “our”, or “us”) warrants that every patch produced at its Birmingham workshop will conform in all material respects to the approved digital proof, the agreed specifications, and the Company’s internal manufacturing and inspection procedures in force at the time of order.

This warranty applies to all customers and operates alongside, not in place of, statutory rights available under applicable UK consumer protection law for B2C orders.

These terms form part of every order placed with Custom Iron On Patches Ltd. By placing an order, the customer agrees to these Warranty Terms together with the Company’s Terms & Conditions and Returns & Refunds Policy.

1. Warranty Scope

1.1 Manufacturing Warranty

The Company warrants that, at the time of dispatch from its Birmingham workshop, the patches supplied will:

a) Match the design, dimensions, colour placement, backing type, and border type specified in the digital proof approved by the customer in writing

b) Match agreed Pantone references or colour specifications within commercially reasonable manufacturing tolerances

c) Match agreed dimensions within a tolerance of +/- 2mm unless otherwise specified in writing

d) Be free from material manufacturing defects, including but not limited to:

  • loose threads
  • missed stitches
  • broken weave
  • mould flaws
  • print misalignment
  • defective backing application
  • significant surface damage
  • incomplete borders or inconsistent edging

e) Be produced and inspected in accordance with the Company’s internal quality control procedures in force at the time of manufacture

1.2 Contractual Warranty Period

The Company’s contractual manufacturing warranty applies for fourteen (14) days from the date of delivery for both B2C and B2B customers unless extended by separate written agreement.

The contractual warranty period applies to claims relating to visible manufacturing defects identifiable upon reasonable inspection after delivery.

This contractual warranty is separate from, and in addition to, any statutory rights available to B2C customers under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

Nothing in these terms limits a consumer’s right to report goods that fail to conform to contract after the contractual warranty period where such rights are protected by law.

1.3 Warranty Holder

The warranty applies only to the original purchasing customer and is not transferable unless expressly agreed in writing.

For reseller and trade accounts, separate commercial warranty arrangements may apply under account-specific agreements.

2. What the Warranty Covers

2.1 Eligible Manufacturing Defects

The warranty covers manufacturing defects identifiable at or shortly after delivery, including:

Proof Non-Conformance

Patches materially differing from the approved proof in:

  • design
  • dimensions
  • colour placement
  • backing type
  • border specification

Production Defects

Including but not limited to:

  • loose threads
  • missed embroidery stitches
  • broken weave
  • PVC mould imperfections
  • air bubbles
  • print misalignment
  • incomplete chenille stitching
  • defective edging

Colour Non-Conformance

Colours materially outside commercially reasonable production tolerances from agreed references.

Dimensional Non-Conformance

Patches outside the agreed dimensional tolerance of +/- 2mm.

Border Defects

Including:

  • malformed merrow borders
  • incomplete border stitching
  • uneven laser-cut edges
  • inconsistent edging

Backing Defects

Including:

  • incorrectly applied backing
  • missing backing
  • defective hook-and-loop application
  • iron-on adhesive failure where:
    • application instructions were followed precisely
    • a compatible garment or substrate was used
    • correct temperature, pressure, and dwell time were applied

Packing Damage

Damage caused by the Company’s packing process before courier collection.

2.2 Quality Control

All batches are inspected before dispatch using the Company’s internal quality control procedures and inspection standards applicable at the time of manufacture.

Minor variations inherent in textile, embroidery, woven, PVC, chenille, and printed patch manufacturing do not constitute defects. This includes:

  • slight thread sheen variation
  • minor colour tone variation
  • minor batch-to-batch differences
  • slight embroidery puckering within industry tolerance

3. Warranty Claim Process

3.1 Reporting a Defect

Customers must report manufacturing defects by:

a) Emailing [email protected] with the order number

b) Providing clear photographs of the issue in standard lighting conditions

c) Specifying:

  • quantity affected
  • nature of defect
  • relevant proof reference where applicable

For B2B customers, goods must be inspected within a reasonable period after delivery and before resale, onward distribution, or application to garments wherever reasonably practicable.

3.2 Claim Assessment

Upon receipt of a claim, the Company will:

a) Acknowledge receipt within one working day where reasonably possible

b) Review submitted evidence against:

  • approved proof
  • agreed specifications
  • internal inspection standards

c) Where reasonably required, request return of sample patches for inspection

d) Confirm or decline the claim within five working days of receiving all necessary information

Where a returned sample is requested and the claim is validated, reasonable return postage costs will be reimbursed.

3.3 Resolution Options

Where a valid warranty claim is confirmed, the Company may provide one or more of the following remedies:

a) Free remake of affected goods

b) Partial refund proportionate to the affected quantity

c) Full refund in circumstances where remake or partial refund is not commercially practical

For B2C customers, statutory remedies under the Consumer Rights Act 2015 take precedence where applicable.

The Company shall not be liable for third-party remake, installation, alteration, application, removal, or replacement costs unless expressly agreed in writing in advance.

3.4 Remake Lead Time

Approved remakes are produced according to the Company’s standard production schedule unless priority production is expressly agreed.

Estimated production lead times are not guaranteed.

4. Warranty Exclusions

4.1 Excluded Circumstances

The warranty does not cover:

Customer Design Changes

Changes requested after written proof approval.

Improper Application

Including:

  • incorrect heat application
  • incorrect pressure
  • unsuitable garment materials
  • incompatible substrates
  • improper sewing methods

Iron-on patches are not guaranteed for:

  • waterproof fabrics
  • coated fabrics
  • nylon
  • softshell garments
  • heavily textured materials
    unless suitability has been confirmed in writing before production.

Normal Wear and Tear

Including:

  • abrasion
  • washing wear
  • thread pulls
  • gradual adhesive degradation
  • fading from ordinary use

Industrial Laundering

Unless industrial-grade production specifications were specifically requested and confirmed in writing before manufacture.

Customer Handling or Storage Damage

Damage occurring after delivery acceptance.

Courier Issues After Dispatch

Including:

  • delayed delivery
  • courier mishandling
  • lost parcels
    except where caused directly by inadequate Company packaging.

Customers must report visible transit damage or missing items within 48 hours of delivery where reasonably possible.

Customer-Supplied Artwork Errors

Including:

  • spelling mistakes
  • inaccurate logos
  • incorrect Pantone references
  • low-resolution artwork
  • copyright or trademark infringement

Cosmetic Variations Within Industry Tolerance

Including:

  • slight colour variance
  • thread sheen variation
  • minor alignment differences
  • normal manufacturing characteristics

Force Majeure

Events outside reasonable control including:

  • strikes
  • war
  • civil unrest
  • pandemics
  • natural disasters
  • government restrictions
  • courier network failures

4.2 Intellectual Property Responsibility

The customer warrants that they own, or are properly licensed to use, all artwork, logos, trademarks, designs, and materials supplied to the Company.

The customer agrees to indemnify and hold harmless Custom Iron On Patches Ltd against any third-party claim arising from supplied artwork or materials.

5. Limitation of Liability

5.1 Liability Cap

For B2B customers, the Company’s maximum aggregate liability relating to any single order shall not exceed the total order value excluding VAT and delivery charges.

This limitation applies only to the extent permitted by law.

5.2 Excluded Losses

To the extent permitted by law, the Company shall not be liable for:

a) indirect or consequential losses

b) loss of profits

c) loss of contracts

d) loss of business opportunity

e) loss of goodwill or reputation

f) third-party claims arising from customer use of the products

g) losses relating to safety-critical or compliance-critical applications unless expressly agreed in writing

5.3 Non-Excludable Liability

Nothing in these terms excludes or limits liability for:

a) death or personal injury caused by negligence

b) fraud or fraudulent misrepresentation

c) breach of statutory rights that cannot lawfully be excluded

d) any liability that cannot legally be limited or excluded

5.4 Consumer Rights

Nothing in these terms affects statutory rights available to consumers under:

  • the Consumer Rights Act 2015
  • the Consumer Contracts Regulations 2013
  • or other applicable consumer protection legislation

Where these terms conflict with mandatory consumer protections, the statutory protections take precedence.

6. Bespoke Goods and Cancellation Rights

6.1 Personalised Goods Exemption

Under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013, consumers do not have a statutory right to cancel personalised or made-to-order goods once production has begun.

As all patches are custom manufactured to customer specifications, no 14-day cooling-off cancellation right applies after:

  • written proof approval; and
  • commencement of production

6.2 Cancellation Before Production

Customers may cancel:

  • free of charge before proof approval
  • after proof approval but before production subject to reasonable charges for completed design and digitising work

6.3 Defective Goods

The personalised goods exemption applies only to change-of-mind cancellations and does not affect statutory rights relating to defective or non-conforming goods.

7. Consumer Rights (B2C Customers)

Nothing in these terms limits statutory rights available under the Consumer Rights Act 2015.

Consumers may be entitled to:

  • rejection rights
  • repair
  • replacement
  • price reduction
  • refund

where goods are not:

  • of satisfactory quality
  • fit for purpose
  • as described

For defects identified within six months of delivery, applicable law may presume the defect existed at delivery unless proven otherwise.

8. Business Customers (B2B)

B2B customers are not consumers for the purposes of the Consumer Rights Act 2015.

For B2B orders:

  • these Warranty Terms form the primary contractual remedy framework
  • implied terms may be excluded to the extent permitted by law
  • the Company’s terms prevail over conflicting customer purchase terms unless agreed otherwise in writing

Separate framework agreements or procurement contracts may supersede these terms.

9. Warranty Documentation

The following documentation may be provided upon reasonable request:

  • warranty confirmation
  • insurance certificates
  • company registration details
  • VAT registration confirmation
  • quality assurance documentation
  • procurement support documents

Order-specific warranty certificates may be issued for procurement or framework contract purposes.

Administrative charges may apply for non-standard documentation requests.

10. Governing Law and Jurisdiction

These terms are governed by the laws of England and Wales.

For B2B customers, the courts of England and Wales shall have exclusive jurisdiction.

Nothing in these terms affects mandatory rights of consumers to bring proceedings in their country of residence where required by applicable law.

11. Changes to These Terms

The Company may update these Warranty Terms from time to time.

The version applicable to an order is the version published on the website on the date the order is placed.
